			<content:encoded><![CDATA[<p>A new study published at <a href="http://www.appleinsider.com/articles/10/03/16/39_of_blackberry_owners_say_theyd_switch_to_an_iphone.html" target="_blank">AppleInsider</a> has revealed that 39% of BlackBerry users say they would switch to the iPhone for their next phone purchase.  The study, by Crowd Science also said 92% of iPhone users are happy with their phones.  Check out the rest of the article from <a href="http://www.appleinsider.com/articles/10/03/16/39_of_blackberry_owners_say_theyd_switch_to_an_iphone.html" target="_blank">AppleInsider</a>:</p>
<blockquote><p>A study <a href="http://www.crowdscience.com/blog/article/android_battles_iphone/">released this week</a> from Crowd Science found that 39 percent of BlackBerry owning respondents said they &#8220;definitely or probably would&#8221; switch to an iPhone if they had to buy a new handset &#8220;tomorrow.&#8221; Another 29 percent said they were unsure, while 31 percent are unlikely to buy Apple&#8217;s handset.</p>
<p>The survey carried even more good news for Apple, as 92 percent of iPhone users said they are satisfied with their purchase and would likely make their next smartphone another iPhone.</p>
<p>Users of the Google Android mobile operating system were also satisfied, with 87 percent saying they would buy another Android handset. In addition, 34 percent of BlackBerry owners would strongly consider buying an Android phone if they were to make an immediate purchase.</p>
<p>The study also found that 97 percent of iPhone users would recommend the product to their friends, and 52 percent of BlackBerry owners and 51 percent of other smartphone users would recommend the iPhone to others.</p>
<p>The study was of 1,140 respondents recruited via the Crowd Science Sample Beta program from Web sites serving more than 20 million unique visitors. Totaling 44 percent, most respondents were users of a traditional cellphone rather than a smartphone. iPhone users represented 17 percent of those polled, BlackBerry users amounted to 15 percent, Nokia 10 percent, Windows Mobile 4 percent, Android 3 percent and Palm 2 percent.</p></blockquote>
<p>Trust me, if you&#8217;re going to buy a smartphone and want apps <strong>now</strong> instead of the promise of apps in the future, buy an iPhone.</p>

			<content:encoded><![CDATA[<p><img class="alignright border" src="http://images.pcworld.com/news/graphics/187901-appleipadpromo_original.jpg" alt="" width="180" height="119" />We have ordered our Apple iPads for <a href="http://www.TechnoEsqPresentations.com">TechnoEsq Presentation</a>s as well as our personal iPad and besides being extremely excited we are already seeing the first iPad app a lawyer can use at trial.  First seen on <a href="http://www.9to5mac.com">9to5mac.com</a>, PadNote looks like it was created for simple drawing at first, but it turns out to be quite useful since it allows annotations on PDF&#8217;s.</p>
<p>It works by allowing the user to open a pdf and make it the &#8220;background&#8221; of a drawing. Once the pdf is opened into the program, it is placed into a document manager and may be called up any time for annotation.  From the short video introduction show below (cheesy music not ours, <strong>highlighting begins midway through</strong>), we can see that users can highlight in any color, draw onto the PDF and type notes just as if the file was opened in Acrobat on a computer except instead of using a mouse, you use the touchscreen of the iPad.</p>

<p>This truly is the solo-practitioner&#8217;s dream for a trial presentation machine since the iPad has a VGA connector accessory which mirrors the iPad&#8217;s screen to a projector.  Thus using this app, an attorney could open a medical record or other document, display it on the screen for the jury and, using his finger, highlight, draw and otherwise annotate the document.  Since the annotations are not permanent but exist on a &#8216;layer&#8217; above the pdf, they can be turned on and off with the push of an icon at the top of the screen.  The days of having an assistant at counsel&#8217;s table trying to figure out where a attorney wants to highlight or zoom on a document with Sanction or Trial Director are over.  Give me an iPad and an projector and I am suddenly a self-contained trial machine.</p>
<p>Unfortunately, our iPads will not arrive until April 3. Check back then for hands-on videos.</p>

David is absolutely correct in his observation that it is not PowerPoint which is futile, but the way it is being implemented.</p>
<p>As David suggests, at <a href="http://www.TechnoEsqPresentations.com">TechnoEsq Presentations</a> we also try and persuade our clients, other attorneys, from using too many words in a presentation and letting the visual aspect of the presentation speak for itself. We often have to convince our clients of this by comparing and contrasting with and without bullet points, but eventually they begin to understand our philosophy behind creating presentations and appreciate the difference it makes in their demand and mediation presentations as well as at trial.</p>

		<description><![CDATA[I apologize to all of our readers for the lack of posting since the beginning of this month. I had an emergency appendectomy on June 8th and while I came home that night, I developed pneumonia three days later and was admitted to the hospital on the 12th. 			<content:encoded><![CDATA[<p>I apologize to all of our readers for the lack of posting since the beginning of this month.  I had an emergency appendectomy on June 8th and while I came home that night, I developed pneumonia three days later and was admitted to the hospital on the 12th.  After spending the weekend on antibiotics and other medications, they discovered that the pain in my abdomen I was complaining about was actually not &#8220;normal&#8221; and was actually an abscess.  So on the 15th they did a CT guided drainage of the abscess, taking out 60cc&#8217;s of fluid from the surgery site.  After spending a week in the hospital, I was released home for the weekend with Percocet to try and take the place of the Dilaudid they had been giving me for my pain.</p>
<p>Needless to say, I of course overdid it upon my return home, taking our dog Shelby to the dog park and taking a quick trip to Kroger where I ran into Judge Willett.  I was on heavy medication at the time so there is no telling what I told him.  Waking up this morning I have now realized that my discharge papers were serious when they instructed me to have plenty of rest; I feel like I was run over by a train.</p>
<p>So I am now resting, but promise to begin posting as usual this week.  We have a great number of posts scheduled, including our review of the new Fujitsu ScanSnap S1500 which replaces the venerable S500 series as well as PaperShow&#8217;s incredible new product (all I can say is think of the LiveScribe pen, but as an overhead display tool).  Thanks to everyone who sent their well-wishes and for everyone&#8217;s patience as I &#8220;get back in the saddle&#8221;.</p>

			<content:encoded><![CDATA[<p><img src="/images/KindleDX.png" align="right" hspace="6">Finis here and I&#8217;m excited of the new announcement of the Kindle DX this morning from Amazon.com. Of course the rumor mills have been talking about this product since the Kindle 2 came out, but I still was not sure what to expect.  As the owner of the Sony e-Reader (first post we ever did here on TechnoEsq) as well as the owner of the original Kindle, I know the benefits of having a portable e-ink reading device.  Almost everyone I show the Kindle to, which is most people since it&#8217;s always with me, is amazed by the readability of the e-ink.  Since it&#8217;s not backlit like your iPhone, it puts no strain on your eyes and so you can find me reading on it constantly no matter where I am.  The only downside is the size of the screen, until now.  With the Kindle DX, Amazon is clearly looking to woo the professional market wanting to view 8.5&#8243; x 11&#8243; documents/books.</p>
<p>The new Kindle DX features a 9.7-inch screen with a resolution of 1200&#215;824 (so pictures look great), 4GB of storage (roughly 3,500 books), native PDF support (something none of the other e-readers have), automatic landscape/portrait text rotation (a la iPhone), free 3G cellular service for transfer of books/documents anywhere you get cell service. The only downside is the $489 pricetag, but e-ink is a new technology and that&#8217;s what happens when you are on the cutting edge.</p>
<p>I am currently pre-ordering mine now as it will ship this summer. I envision finally being able to read depositions, pleadings and medical records on my Kindle, something I could do on my 1st generation Kindle, but the screen was just too small to really see. You can annotate PDF&#8217;s with the Kindle DX as well as search and find definitions of words. Below will take you to a great video Gizmodo did of the Kindle DX hands-on and we will have a TechnoEsq review of the DX as soon as possible.<br />

<p>The price seems rather high for something which, while providing easy access to legal terms and phrases, is still not something a lawyer has been caught wishing he had on his iPhone.  Black&#8217;s Law Dictionary will provide not only the same definitions of legal terms and phrases, but also embedded audio of the same information.  These definitions are taken from the 8th edition of the Black&#8217;s Law Dictionary.</p>
<p>The application does not require an Internet connection, which means all of you who purchased an 8GB iPhone rather than a 16GB are going to start feeling the pinch as more and more apps store all of their information on your phone.
