Using it in trial would be great, but we have to remember that not all courts permit recording. California state courts, for example, require permission from the judge. I've bought two of the pens, one for my nephew and one for my daughter, both students. I love the technology, and I'm desperately trying to justify it for myself. Unfortunately I'm an appellate lawyer, so I would have to talk to myself.

I have had a Livescribe for about two months and I think that it is potentially an invaluable tool for a lawyer. As you have noted though, the biggest (and perhaps insurmountable) drawback is that there are bans against making recordings in both Federal Court and the State Courts of Indiana, where I practice. I don't see how those can be gotten around. I don't think that our State Trial Courts can even grant permission to use one because of the pertinent Supreme Court rules imposing restrictions.

Until we get the rules changed, the best uses for lawyers don't exist.

I would think sidebar conferences would be the only thing you would need leave of court to record. However, I would always ask the court's permission prior to recording any proceeding.

Would you need to obtain leave of court to allow the recording of trial testimony, sidebar conferences and other trial matters?
